Utter Shole Shapley (Thomas, Johannah), the son of Thomas and Johannah, was born on May 28, 1754 in Killingly, Windham County, Connecticut WH13. Utter Shapley, the son of Thomas, was baptized on June 9, 1754 at the Thompson Congregational Church in Thompson, Windham County, Connecticut CO29. Utter, who was in the Charlotte County militia, received land bounty rights NE15. Charlotte County was later renamed to Washington County, New York. He married Sarah sometime before the birth of their daughter, Sarah, who was born circa 1780 BE5. A petition to the Vermont legislature was signed by Utter “Chaply” and Richard “Chaply”; they were among seventy-one men who wanted to establish a new township called South Granville VE6, BE5. The petition was filed on June 14, 1782, and has been transcribed below VE6:

 

To the Honnerble the Legislatur of the State of Vermont

Wee the Subscribers Your Humble Petitioners Begeth that your Honners would be so greacious for a Reasonble fee Make a Grant of the South town of Granvill Begining at the Northwest Corner of the town of Powlet [Pawlet] Runing thence West Sixe [the preceding number is uncertain because a mark obscured the first letter, and the “x” was not crossed, however, the word strongly resembled the same word used later, and the uppercase “S” was written frequently enough in this petition to make an accurate comparison] Miles to a stake and stones thence South Five [this word was also indistinct, as someone wrote over it; if it was not “Five”, then it was probably the word “Sixe”] Miles to a stake and stones thence East Sixe miles to the Northwest Corner of Rueport [Rupert] thence North along the west Line as Powlet afore said to the first Bounds – As your Humble Petitioners In duty Bound will Ever Pray

 

In 1793, Utter registered an ear mark FO1. Unique ear marks were used to distinguish the ownership of cattle in the early colonial days of America, before fences were built. In this way, wandering cattle could be matched with the owner, because no two registered ear marks were identical. Utter Shapley was assessed tax in Granville, Washington County, New York in the years 1799 through 1802; his real estate, which was described as a farm, was valued at 408 pounds each year and the value of his personal estate varied between sixty-two and seventy pounds, and for this he was assessed a tax of between forty-four to ninety-nine cents, depending on the year NE35. Utter Shapley purchased a tract of 100 acres land in Oxford, Chenango County, New York on May 30, 1804 from Joshua Mersereau for the sum of $380 CH17:

 

This Indenture made this thirtyeth day of May in the year of our lord Eighteen hundred & four between Joshua Mersereau of Union Tioga County in the State of New York Esq. of the first part and Utter Shapley of Oxford in the County of Chenango of the Second part Witnesseth that the said party of the first Part for & in Consideration of the sum of three hundred & Eighty Dollars lawful money of the United States to him in hand paid by the said Party of the Second Part the receipt whereof is hereby acknowledged and confessed hath and by these presents doth grant bargain sell alien… enfeoff convey and confirm unto the said party of the second part and to his heirs and assigns forever all that certain piece or parcel of land situate lying and being in the town of Oxford in the County of Chenango and State aforesaid being the North West part of lot No 7. in the said Town of Oxford formerly called Fayette Beginning at the North West Corner of said lot and running Easterly on the line of the said lot two hundred Rods, thence South on a right angle Eighty rods, thence westerly on a Parallel line with the first mentioned line to the Westerly bounds of said lott thence Northerly on the West bounds of said lott eighty Rods to the place of beginning to contain one hundred Acres and no more. Together with all and singular the Hendilaments [this word should read “Hereditaments”] and appurtenances thereunto belonging or in any wise appertaining, and also all the Estate Right title, Intent Property claim and demand whatsoever of heir the said party of the first part of in and to the aforesaid described and granted land and Premises with the appurtenances. To Have and to Hold all and singular the aforesaid described and granted land and Premises with the appurtenances unto the said party of the second part his heirs and assigns to his and their own proper use benefit and behoof forever. And the said party of the first part doth hereby Covenant promise and engage to and with the said party of the second part his heirs and assigns that he is true and lawful owner of the said land hereby conveyed and hath in him himself good right and full and lawful Authority to grant bargain sell and convey the same free clear acquitted and discharged off and from all incumbrances Whatsoever and the same in the peacable and quiet possession of the said party of the second part his heirs and assigns against the lawful claim and claims, demand and demands of all and every Person and Persons lawfully claiming the same shall and will forever Warrant and defend. In Witness whereof the said party of the first part hath to these presents affixed his hand & seal the day and year first above written

 

Later that year, Utter and Sarah deeded their son, Thomas G. Shapley, thirty acres of that parcel of land CH17:

 

This Indenture Made the Eighteenth day of November in the year of one thousand Eight hundred an[d] four Between Utter Shapley of Oxford in the County of Chenango and State of New York and Sarah his wife of the first part and Thomas G Shapley of the Same place of the second part Witnesseth that the said party of the first part for and in consideration of the sum of One hundred and fourteen Dollars to him in hand paid by the party of the second part Wherewith the said party of the first part doth hereby declare themselves Satisfied and paid have and by these presents do grant bargain sell alien release Convey and Confirm unto the said party of the Second part his Heirs and assigns All that Certain piece or parcel of land lying in Oxford aforesaid being part of lot Number Seven in the township of Fayette and being thirty acres of said lot and thirty acres to be taken off from the north side of the land deeded by Joshua Mersereau by his attorney Josuah Mersereau Junior to the said Utter Shapley on the thirtyeth day of May 1804 Said Thirty acres hereby meant to be conveyed to run the Whole length of said land deeded by said Mersereau to said Shapley and to extend South so far from the north line as to include said thirty acres being twenty six rods and two thirds of a rod wide Together with all and Singular the rights members privileges to the same belonging or as any wise appertaining And the reversion and reversions remainder and remainders rents issues and profits thereof and all the estate rights title interest property possession claim and demand both in law and equity of of [sic] the said party of the first part of in and to the same To have and to hold the said tract or parcel of land and premises with the appurtenances unto the said Thomas G Shapley his heirs and assigns to his and their only proper use benefit and behoof forever and the said party of the first part do for their Executors and Administrators Covenant and agree to and with the party of the second part his heirs and assigns that he the true and lawful owner of the said tract or parcel of land and premises with the appurtenance and hath in him good right full power and lawful authority to grant and convey the same in manner aforesaid And that he the said part[y] of the first part and his Heirs the said parcel of land and premises unto the said party of the second part his heirs and assigns shall and Well Warrant and forever by these presents defend

 

Utter and Sarah “Chapley” sold the 100-acre parce of land in Guilford, Chenango County (which they had originally purchased from Joshua Mersereau) on April 22, 1833 to Azor Burlisson CH17:

 

This Indenture, Made the twenty second day of April in the year of our Lord one thousand eight hundred and thirty three Between Utter Chapley and Sarah his wife of the town of Guilford county of Chenango and State of New York of the first part and Azor Burlisson of the same place of the second part Witnesseth that the said party of the first part for and in consideration of the sum of one thousand dollars money of account of the United States to them in hand paid by the said party of the second part the receipt whereof is hereby confessed and acknowledged have granted bargained sold remised released aliened and confirmed and by these presents do grant bargain sell remise release alien and confirm unto the said party of the second part and to his heirs and assigns forever All that certain piece or parcel of land lying and being in the town of Guilford aforesaid (formerly fayette township) Beginning at the north west corner of said lot and running easterly on the line of the said lot fifty chains thence south on a right angle twenty chains thence westerly on a parallel line with the first mentioned line to the westerly bounds of said lot thence northerly on the west bounds of said lot twenty chains to the place of beginning containing one hundred acres of land and no more it being the north west part of lot No 7 in said township Together with all and singular the hereditaments and appurtenances thereunto belonging or in any wise appertaining and the reversion and reversions remainder and remainders rents issues and profits thereof: and all the estate right title interest claim or demand whatsoever of the said party of the first part either in law or equity of in and to the above bargained premises with the said hereditaments and appurtenances. To have and to hold the said tract or parcel of land and premises with the appurtenances unto the said party of the second part his heirs and assigns to his only proper use benefit and behoof forever. And the said party of the first part do for their heirs executors and administrators covenant and agree to and with the said party of the second part his heirs and assigns that they are the true and lawful owners of the said tract or parcel of land and premises with the appurtenances and have in themselves good right full power and lawful authority to grant and convey the same in manner aforesaid. And that the said party of the first part themselves and their heirs the said parcel of land and premises unto the said party of the second part and to his heirs and assigns against all lawful claims and demands whatsoever shall and will Warrant and forever by these presents Defend In witness whereof the said party of the first part have hereunto set their hands and seals the day and year first above written

 

He was not found in the 1830 or 1840 census records, nor did he reside with any of the Shapley men of Chenango County in those decades, because there was no tally mark for a man of his age listed with those men. Utter’s gravestone, located in the Guilford Center Cemetery in Chenango County, was engraved with a death date of July 25, 1841.

·        1790 US Census: lived in Granville, Washington County, New York with one boy younger than sixteen and four females (their age range was not noted).

·         1800 US Census: lived in Granville, Washington County, New York with one young man aged sixteen to twenty-six, two girls who were ages ten to sixteen, one young woman aged sixteen to twenty-six, and a woman who was older than forty-five. Oddly, there was no tally mark for Utter (Otter). The only tally mark for any male was the one mentioned for a male aged sixteen to twenty-six.

·         1810 US Census: lived in Oxford, Chenango County, New York with one woman over the age of forty-five.

·         1820 US Census: lived in Guilford, Chenango County, New York with his wife; they were both listed as being over age forty-five.

Sarah was probably born circa 1753, because according to her headstone, she died at age eighty-five on March 18, 1838 BE5. Her surname was possibly “Garner” BE7. Sarah was the mother of Sarah, Thomas Garner, Susannah, and Betsey BE5. Sarah Shapley was born about 1780, based on her age at the time of her death BE7. Sarah Shapley died at age thirty-six on February 16, 1816 and was buried at Brooksbanks Cemetery on Basswood Road in Oxford Township, Chenango County, New York GA5.

Thomas Garner Shapley was born about 1785, based on his age at the time of his death NE32, BE7. Thomas Garner Shapley married Martha Padgett, the daughter of John and Hannah Padgett GA2, GA5, CH3. Thomas G. Shapleigh was enumerated on the same census record as David Shapley in the 1820 US Census in Oxford, Chenango County, New York UN7. Thomas was the father of Lydia Japhet, the wife of Alden Japhet, Thomas W. Shapley, Olive Shapley, Sally Shapley, Joseph W. Shapley, David U. Shapley, Anna Shapley, James Shapley, and John P. Shapley CH3. Thomas G. Shapley died “a natural death” intestate CH3 at age forty-seven on February 7, 1832 and was buried on an abandoned plot on Bliss Willoughby, which was called the Hovey Farm at the time of the survey of that cemetery in 1930 GA5, NE32. The probate record of Thomas G. Shapley named his nine children, as well as relatives of his children who were over the age of twenty-one, for the purpose of appointing a guardian for his youngest son, John P. Shapley, who was yet a minor CH3. The document in his probate record entitled “Citation To The Relatives of John P. Shapley” named “Uttery” Shapley and his wife, Sally, Asor Burlison and his wife, Betsey, James Walker and his wife, June, James Padget, Robert Padget, John Padget, Martha Shapley, Olive Shapley, and Sally Shapley, who were “all the relations of John P Shapley in the County of Chenango over twenty one years of age…” CH3. This document implies that Sarah may have been called Sally, and it linked Robert Padgett to the Shapley family, although it failed to name Susannah (Shapley) Padgett as a potential guardian of her nephew, John P. Shapley.

Susannah Shapley was born circa 1784 UN10 or 1785 NE30 in Vermont UN10, NE30. Betsey Shapley was born about 1790, based on the age at her death, and married Azor Burlinson BE7. Azor and Betsy Burleson lived in Guilford, Chenango County, New York in 1850 UN10. Betsey Burlinson, the wife of Asor Burlinson, died at age sixty-one on March 20, 1851; Asor died at age seventy-four on April 17, 1859 GA5. Azor Burlisson wrote his will on October 4, 1854, which named his children, Hiram A. Burlisson, Herman Burlisson, Julia Evans, Diana Herrick, and Betsey Ann Haynes NE36. Betsey and Asor were buried at Guilford Center Cemetery in Guilford Township, Chenango County, New York GA5.

Sarah Shapley, the wife of Utter Shapley, died at age eighty-five on March 18, 1838, and was buried at Guilford Center Cemetery in Guilford Township, Chenango County, New York GA5. A photograph of a gravestone in this cemetery has been attributed to her, but weather has eroded the words on the stone to illegibility.
